This sounds like fantasyland to me. What grounds does Chloe have for keeping Holly? I can only see Deimos’ character/dealings coming into play. Unless he is found guilty of putting hits out I just don’t see the legal basis. Chloe did not tell Nicole from the getgo what she was doing and then when she did find out the procedure worked still didn’t tell her. This is not Chloe’s child and there is no reason for Nicole to be denied custody. If this hinges on Deimos being a danger to the baby I’m rolling my eyes.
But of course that’s in the real world. This is Salem and we don’t know exactly how foolproof the surrogate contract was.it wouldn’t surprise me if she ran off with this kid at some point. She’s not giving up this baby now that she’s nursing her, whether Deimos is in the picture or not! She better watch her back where he’s concerned. She may wind up losing both Holly and Parker, since they are both Daniel’s bio-kids.
because I was curious as to if Chloe did have any rights to this baby. It seems the laws vary from state to state and the surrogacy contract is not always enforceable in some states. I even read of women who changed their minds and moved to states that were more surrogate friendly so they could keep the baby.
That being said I’m sure that nowhere in the contract did it state that the embryos were Chloe’s to do with as she wished. And though she could try as often as she was willing, I doubt she could try wihtout informing Nicole and Daniel. So to me, it is like she stole that baby right from the start. But i’m not a lawyer, and certainly not a Salem lawyer, LOL. And if Deimos hadn’t changed his mind about being with her SHE would be the one with him now. And what would she have done about that baby then? I’m pretty sure this is a woman scorned story and nothing as pure and sacred as Chloe is making it out to be.
why Nicole didn’t offer to give up Deimos to begin with. She’s always wanted a baby, she has one, and the only thing standing in her way is her boyfriend? Really? Once she has custody, she can do whatever she wants. Also, I thought giving Maggie temporary custody might be in the cards. She’s Parker and Holly’s grandmother.
I wonder if Deirdre Hall has any opinions or input on this story since bothe of her children were carried by a surrogate. Also, this case involves Chloe carrying a child that is not hers biologically. Many times surrogates carry children that are biologically theirs and I can see the laws working in their favor. But I don’t see how Chloe has a leg to stand on. Even if Nicole were to go to jail, which she won’t, I think Maggie would have more rights to that baby.

I agree with everything you said but apparently there is not one all encompassing legal statement regarding surrogacy, dumb as it sounds given the prevalence of surrogacy today.
There was one woman I read about who was carrying a child that was diagnosed with severe disabilities and the parents wanted her to abort. She refused and moved to a different state that gave the surrogate rights over the baby so she could deliver the child…then of course opened a go fund me page or one of those things to help pay for the child’s medical care if I remember the story correctly.
I agree that there’s no way Chloe should have any sort of custody rights. They wouldn’t have allowed her to implant any embryos without Nicole knowing. With that part of belief suspended, I still don’t think Chloe is a bitch. If Nicole wants that baby she should get her priorities straight. She has a million reasons not to trust Deimos. He hurt Maggie, Phillip, he even manhandled her by the river yet she’s so desperate for a man she accepts he’s changed based on what? A piano ditty? Stop it. She’s impulsive and irresponsible. Chloe is right about her. From the very beginning if Nicole had dumped Deimos none of this would have happened. While Chloe’s past is less than stellar in this instance she is the more responsible parent. Sorry but if Nicole doesn’t grow up she doesn’t deserve her baby.
